Privacy & Terms Of Use
Who You Are Buying From
Dayton Live’s Ticket Office acts as the agent to those who are promoting or otherwise providing the events for which you purchase tickets, such as arts groups, promoters, or other outside licensees of the venue (each an “Event Provider”). When you purchase a ticket for an event, Dayton Live’s Ticket Office will only be handling the transaction and collecting payment on behalf of the Event Provider. If an event is canceled or you otherwise become entitled to a refund, the Event Provider will be exclusively responsible for issuing the refund.
Performance Policies
Latecomer seating Policy
For the consideration of our patrons, House Management may not seat anyone in his/her regular seats while a performance is in progress. Patrons will be seated in accordance with the policies of the presenter.
House Policy
Management reserves the right to refuse admission. Many productions do not permit children under 6 or may contain material that may not be appropriate for children under 13. Please contact the Ticket Office or review the event listing on DaytonLive.org for the children’s policy for specific productions.
Emergency Contact
The emergency number during performances is 937-637-7366.
Ticket Policy
Refunds & Exchanges
Before purchasing tickets, carefully review your event and seat selection. Policies established by our Event Providers generally prohibit Dayton Live’s Ticket Office from issuing exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets. You agree that you will not, in those circumstances, seek a “chargeback” from your credit card issuer or otherwise dispute the charge for the tickets.
Pricing & Availability
Because Dayton Live’s Ticket Office sells tickets on behalf of Event Providers, the Ticket Office does not set the ticket prices or determine seating locations. Tickets are generally sold through several distribution points, including online, phone and box offices. All distribution points generally access the same ticketing system and inventory. Therefore, tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, the Ticket Office does not control this inventory or its availability. Our Event Provider clients decide at their sole discretion which of their tickets are made available for public sale. The tickets we sell belong to our clients and typically represent only a portion of (and sometimes substantially less than) the total venue seating capacity. On occasion, additional tickets may be released by the Event Provider as late as the event date.
Senior and Student discounts may be available for an event but not made available online per the instructions of the Event Provider. To purchase tickets with these discounts, you may need to call the Ticket Office directly at 937-228-3630.
Payment Methods
DaytonLive.org accepts American Express, Visa, MasterCard and Discover credit/debit cards.
Order Confirmation
If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Dayton Live’s Ticket Office whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process.
If you assume that an order has not been placed because you do not receive a confirmation, you will nonetheless be obliged to pay for the tickets if your order was in fact accepted.
Convenience Charges & Order Processing Fees
Tickets purchased on DaytonLive.org are typically subject to a non-refundable per ticket processing fee and a delivery charge. We reserve the right to hold any tickets in will call regardless of the delivery method selected.
Delivery Methods
When purchasing tickets on DaytonLive.org will default to print at home (aka emailed pdf tickets), or you may choose your preferred delivery method from the available options. Regardless of the delivery method selected, we reserve the right to hold tickets at will call.
Amount Of Tickets Per Customer Or “Ticket Limits”
When purchasing tickets on DaytonLive.org, you are limited to a specified number of tickets for each event (also known as a “ticket limit”). This limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.
Billing Information Verification
Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, Dayton Live’s Ticket Office will attempt to contact you, using the information provided at the time of purchase. If the Ticket Office is unable to reach you after its initial attempt, they may cancel your order and may sell your tickets to another customer without further notice.
Pricing & Other Errors
If the amount you pay for a ticket is lower than the correct price regardless of whether because of an error in a price posted on this website or otherwise, or you are able to order a ticket before its scheduled on sale or presale date, or you are able to order a ticket that was not intended to have been released for sale, then Dayton Live’s Ticket Office will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether the mistake is the result of human error or a transactional malfunction of this website or other Dayton Live operated system.
License; Ejection & Cancellation; No Redemption Value
Each ticket that you purchase is a license to attend a particular event, and is subject to the additional terms set forth on that ticket. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language, or who fails to comply with the Event Provider or venue rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is not redeemable for cash.
Unlawful Resale Of Tickets; Commercial Purposes
Tickets may not be purchased with the intention of reselling the tickets at a profit. Unlawful resale of tickets (or attempted resale) is grounds for seizure and cancellation without compensation. A ticket may not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by the Event Provider, provided that even if such consent is obtained, any use of trademarks and other intellectual property of Dayton Live (formerly Ticket Center Stage or Victoria Theatre Association) is subject to Dayton Live’s consent.
Your Responsibilities; Our Rights
Ticket Limits
You must adhere to published ticket limits. Utilizing automated means to process or place ticket orders for a number of tickets that exceeds the stated limit is a violation of these Terms of Use. Persons who exceed the ticket limit may have any or all of their orders and tickets cancelled without notice by Dayton Live’s Ticket Office in its discretion. This includes orders associated with the same name, email address, billing address, credit card number or other information.
Compliance With Laws; Accuracy Of Information
The sale or purchase of tickets to entertainment events may be regulated by certain state, county and city laws or regulations. You acknowledge that complying with laws and regulations is your responsibility.
You may be asked to provide information during various processes that you engage in on the website. You represent and warrant that all information you provide, including but not limited to all information concerning your name, address, credit card number, and other identifying information of any nature, will be true, complete and correct, and that you will update all information as it changes.
Any information you submit to us may be provided to law enforcement officials to assist in any investigation or prosecution being conducted by the officials.
Rights Of Dayton Live’s Ticket Office
You understand and agree that, in addition to other rights of Dayton Live, Dayton Live’s Ticket Office may, in its sole discretion and without prior notice, terminate and block your access to the website or to Dayton Live’s other services, cancel your ticket order and/or tickets acquired through your ticket order, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts Dayton Live’s Ticket Office believes may be associated with you, cancel a ticket or ticket order associated with any person acting or believed to be acting in concert with you, or exercise any other remedy available, if Dayton Live believes that your conduct or the conduct of any person with whom Dayton Live believes you act in concert, or the user content you provide, or any resale of such tickets purchased through Dayton Live’s Ticket Office, violates or is inconsistent with these Terms of Use or applicable law or regulations, or violates the rights of Dayton Live, a client of Dayton Live or another user of the website. If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment or remittance process, or any other process, or if we are no longer able to verify your credit card or bank account information, your tickets may be cancelled, we may refuse to honor all pending and future ticket purchases made on such credit card accounts and/or on any online accounts associated with such credit card accounts, and you may be prohibited from using the website.
